Trademark Renewal & Maintenance Services

Get support with U.S. trademark maintenance and renewal. Review your registration details, relevant requirements and the scope of your next filing.

01

Begin with the registration record

Provide your registration number, owner, registration date and any notice you received. The filing basis matters: a Madrid-based U.S. registration can have different maintenance procedures from a registration based on a national application.

02

Declarations and renewal have different purposes

A Section 8 declaration generally addresses continued use or qualifying excusable nonuse. Section 9 is the renewal application for applicable registrations. Section 71 addresses U.S. use requirements for applicable Madrid-based registrations. These filings should not all be described as the same renewal.

03

Maintenance at 5–6 years

For applicable U.S. national registrations, file a Section 8 declaration between the fifth and sixth anniversaries of registration. It addresses continued use or qualifying excusable nonuse. Confirm your registration basis and evidence before preparing the filing.

04

Renewal at 9–10 years and later 10-year periods

For applicable U.S. national registrations, the combined Section 8 declaration and Section 9 renewal application are filed between the ninth and tenth anniversaries, then in each later 10-year renewal period, such as years 19–20 and 29–30. Madrid-based registrations follow Section 71 U.S. maintenance requirements and separate international renewal arrangements.

05

Section 15 is a separate choice

A declaration of incontestability under Section 15 is optional and has its own requirements. It is not a substitute for required maintenance and does not mean a registration is immune from every challenge.

06

Use evidence must reflect the facts

Review the goods or services still in use and the real evidence supporting the filing. Do not retain items simply because they appeared in the original application, or submit fabricated specimens or invented dates.

07

Check the actual filing window

The required filing and any applicable grace period depend on your registration. Check current USPTO requirements and the official record. This service page does not calculate an individual deadline or promise that a missed window can be corrected.

08

Agree on costs and next steps

Maintenance may involve more than one form or fee. Review service charges, government fees and the work covered by the quote. A registration that has already been canceled requires a different review from an upcoming renewal.

09

Missed deadlines need prompt review

USPTO guidance provides a six-month grace period for applicable required maintenance and renewal filings, with additional fees. After that period, a registration can be canceled or expire. Do not assume restoration is available. Check the official record promptly; an inquiry does not extend a deadline.

10

Monitoring does not complete a renewal

Trademark monitoring helps organize potentially relevant activity. Renewal and maintenance concern your own registration and required filings. A monitoring subscription does not satisfy those obligations unless the separate filing work is expressly included.

Questions about this service

When are maintenance and renewal filings needed?

Applicable U.S. national registrations generally require Section 8 maintenance at years 5–6, and combined Section 8 and Section 9 filings at years 9–10 and later 10-year renewal periods. Check the actual registration basis and official record; Madrid-based registrations have different procedures.

Does Section 15 replace required maintenance?

No. Section 15 is an optional declaration with its own requirements. It does not replace required filings or make a registration immune from every challenge.

What if a filing deadline was missed?

Applicable required filings have a six-month grace period with additional fees. After that period, a registration can be canceled or expire. Promptly review the official record; restoration is not guaranteed.

Does monitoring renew my registration?

No. Monitoring and maintenance filings are separate tasks. Confirm whether the agreed service includes filing preparation and which fees apply.
