Move from intent to actual use
Statement of Use Filing Support
For an intent-to-use application, a Notice of Allowance is an important step, but it is not a registration. Before registration, an eligible applicant must generally show qualifying use of the mark in commerce through a Statement of Use, or request more time when permitted.

Prepare the right use information
A Statement of Use involves the mark as actually used, the goods or services covered, dates of use, and an appropriate specimen. We review the information available and discuss whether filing now or considering an extension fits the record.
- Notice of Allowance and USPTO serial number
- The goods or services currently in use
- Real-world examples of the mark in use, with relevant dates
If you need more time
The USPTO generally provides six months from the Notice of Allowance to file a Statement of Use or an extension request. Eligible extensions may be requested in six-month periods, subject to limits and fees. We check the actual record and deadline before recommending a filing.
After you file
The USPTO reviews the Statement of Use and may approve it or issue an Office Action about the filing. A specimen or use-related issue may require a separate response. Filing a Statement of Use does not guarantee registration.
Questions about this service
Can I use a mockup as a specimen?
The USPTO generally expects a real example of the mark used in commerce. We review the proposed specimen against the requirements for the goods or services at issue.
What if the USPTO objects to my Statement of Use?
The examiner may issue an Office Action. We have a separate review path for a nonfinal Statement of Use Office Action.
